  2. 2. iTutor.com Role and Liability

    The platform operates as a marketplace connecting parents, students, and tutors. iTutor.com does not employ tutors, and we are not responsible for the conduct, actions, or performance of any users.

    The company holds no liability for disputes or interactions between users, including those involving minors.

  3. 3. User Responsibilities

    Users must provide accurate information during registration. Tutors are solely responsible for the representations they make about their qualifications, experience, and availability. The platform does not verify user claims.

    Respectful behavior is required; violations may result in suspension.

  4. 4. Data Collection and Use

    iTutor.com reserves the right to collect, store, and use any data, recordings, or messages exchanged through the platform for improving services, training models, and analysis, while complying with applicable data protection laws.

  5. 5. Non-Circumvention

    Users cannot engage in off-platform tutoring arrangements after being introduced through iTutor.com. If a user engages in tutoring sessions or business arrangements outside of the platform after being introduced through iTutor.com, that user will be subject to immediate suspension or termination from the platform and may owe iTutor.com 100% of the fees generated from such arrangements.

  6. 6. Tutor Status: Independent Contractors

    Tutors acknowledge that they are independent contractors and not employees, agents, or representatives of iTutor.com. They handle their own taxes, insurance, and legal compliance.

  7. 7. Tutor Liability

    Tutors bear responsibility for profile accuracy, including qualifications and experience. The platform is not liable for false information or tutoring outcomes.

  8. 8. Fees and Payment

    All payments must process through iTutor.com. Bypassing the payment system results in termination under the Non-Circumvention clause.

  9. 9. Termination

    iTutor.com reserves the right to suspend or terminate a user's account for any reason, including but not limited to violation of these Terms, non-payment, or inappropriate behavior.

  10. 10. Termination for Breach of Terms

    The platform may terminate accounts at its sole discretion, for any breach of these Terms or any misuse of the platform, without prior notice.

  11. 11. Refund Policy

    All payments made through iTutor.com are non-refundable unless otherwise specified in the applicable service agreement or fee schedule. Terminated users forfeit refunds.

  12. 12. Dispute Resolution and Arbitration

    Any disputes, claims, or controversies arising out of or related to your use of iTutor.com or these Terms shall be resolved exclusively through binding arbitration rather than in court. Users waive jury trial and class action rights. Claims must be brought within one year.

  13. 13. Limitation of Liability

    The platform disclaims liability for indirect, incidental, or consequential damages resulting from platform use or user conduct.

  14. 14. Indemnification

    Users agree to indemnify, defend, and hold harmless iTutor.com, its affiliates, directors, officers, employees, and agents from claims related to their use, violations, or breaches.

  15. 15. No Guarantee of Results

    The platform makes no guarantee of any specific outcomes or results from tutoring sessions, as outcomes depend on student factors beyond the service's control.

  16. 16. Disclaimer of Warranties

    iTutor.com is provided on an "as-is" and "as-available" basis. The platform makes no warranties regarding operation, content, or freedom from harmful components.

  17. 17. Age Restrictions

    Minors under 18 may use the platform with parental consent. By registering a minor for iTutor.com, the parent or legal guardian assumes full responsibility for the minor's use of the platform.

  18. 18. Third-Party Services

    The platform integrates third-party providers but is not responsible for their operation or security.

  19. 19. Right to Investigate

    iTutor.com reserves the right to investigate any activity on the platform that it deems suspicious, unlawful, or in violation of these Terms, including monitoring communications and reviewing transaction history.

  20. 20. Prohibited Uses

    Users cannot engage in harassment, illegal activity promotion, identity misrepresentation, fraud, unauthorized access, or reverse engineering. Violations may result in termination and legal action.

  21. 21. Privacy and Data Security

    The platform implements reasonable security measures but cannot guarantee complete protection. Users must report suspected breaches. See the Privacy Policy for details.

  22. 22. User-Generated Content License

    By uploading, submitting, or sharing any content on iTutor.com, users grant iTutor.com a worldwide, non-exclusive, royalty-free, irrevocable license to use, modify, distribute, display, and reproduce such content.

    The platform uses cookies and tracking technologies to enhance user experience and gather usage data per the Privacy Policy.

  24. 24. COPPA Compliance

    iTutor.com complies with the Children's Online Privacy Protection Act and does not knowingly collect information from children under 13 without parental consent.

  25. 25. Intellectual Property Rights

    All platform content and intellectual property belong to iTutor.com or its licensors. Unauthorized use is prohibited and may trigger legal action.

  26. 26. Prohibition on Scraping and Data Usage for Competitive Purposes

    Users are strictly prohibited from using any automated systems, bots, crawlers, or scraping tools to extract data from iTutor.com for any purpose. Using platform data to create competing services results in termination and legal claims.

  27. 27. Force Majeure

    The platform is not liable for failures caused by circumstances beyond reasonable control, including natural disasters, pandemics, or technical failures.

    If any term is found unenforceable, remaining provisions continue, and the invalid term is modified to reflect original intent.

    iTutor.com may modify these Terms anytime. Continued use after notification constitutes acceptance of changes.
